1. GENERAL PROVISIONS

1.1. UAB Armitana, company code 151182221, registered office address Eigulių str. 11-1, Vilnius (hereinafter referred to as the “Data Controller”) is the controller for the processing of your personal data collected at www.topsluxury.store (hereinafter referred to as the “Website”).

1.2. Your personal data is processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and also other regulations currently in force, i. y. during the entire period of data processing, the legal provisions on the protection of personal data are followed: the Law on the Legal Protection of Personal Data of the Republic of Lithuania, other legal acts of the European Union and the Republic of Lithuania.

2. COLLECTING, PROCESSING, AND STORAGE OF PERSONAL DATA

2.1. The Data Controller follows these principles for the processing of personal data:

2.1.1. Your data is only processed lawfully, fairly, and transparently.

2.1.2. Your data is collected for specified, explicit, and legitimate purposes and is not further processed in a way incompatible with those purposes.

2.1.3. Your data is collected and processed in such a way that it is accurate and is updated as it changes. Inaccurate data will be corrected or deleted.

2.1.4. Your data shall be stored in such a form and for such a period of time that the data subjects can be identified for no longer than is necessary for the purposes for which the data were collected and processed.

2.1.5. Your data will be processed in such a way that ensures its security by using appropriate technical or organizational measures, including protection against unauthorized or illegal data processing and accidental data loss, destruction, or damage.

2.2. Categories of data collected and managed by the Data Controller:

2.2.1. Creating and managing your user account To create and manage a user account for a new customer, the Data Controller collects and processes the following personal data: name, social title, e-mail address, technical information about your computer, mobile phone, or other devices you use, customer number

2.2.2. Handling orders When you make a purchase, the following personal data is processed in order to carry out identification, manage payments, and deliver ordered products: name, social title, e-mail address, billing and/or shipping address, telephone number, payment information (e.g. transaction reference, transaction date), order information.

2.2.3. Managing customer service cases To respond to inquiries submitted to customer service through phone, whatsapp, or social media channels; manage return, complaint, and warranty issues, and investigate complaints, the Data Controller collects and processes the following personal data: name, e-mail address, telephone number, information about the purchase date, complaints about the product.

2.2.4. Sending newsletters The following personal data is collected and processed by the Data Controller with your consent to subscribe to our newsletters: e-mail address.

2.2.5. Conducting statistical and market research To make services more user-friendly, to analyze Website user behavior and traffic on the Website, and conduct statistical and market research, the Data Controller collects and processes the following personal data: purchasing and user-generated data, place of residence, age, your feedback about your shopping experience, technical data (device, time zone, operating system, ect.).

2.3. Data storage procedures and periods

2.3.1. Personal data obtained while creating and managing your user account is stored for as long as you have an active account. Activity means that you have made a purchase in the last 36 months or logged in to the Website.

2.3.2. Data collected after you make a purchase is stored until the purchase has been executed and for a further period of 36 months. For customers shopping without logging in, personal data is stored for 6 months after their most recent purchase.

2.3.3. Data obtained in customer service cases is saved for 36 months.

2.3.4. Data collected from newsletter subscribers is stored until you unsubscribe from our newsletters.

2.3.5. Statistical data is collected with cookies (read our COOKIES POLICY below) and stored for 36 months.

2.3.6. The data shall be stored for no longer than it is required for the purposes of the data processing or required by the law. Exceptions to the storage periods stated before are only possible if they do not violate your rights, comply with legal requirements, and are properly documented. Also, your data might be stored longer than specified if it‘s required for legal grounds (civil, administrative, or criminal).

2.4. Transfer of data to third parties

2.4.1. Your data may be transferred to Data Controller's partners to help ensure the smooth operation of the software and technical support.

2.4.2. Your data may be passed on to the Data Controller‘s partners assisting in marketing activities: companies providing advertising, SMS, media planning, public relations, and event management services.

2.4.3. Your personal data may be provided: to law enforcement authorities in accordance with the procedure provided for by the legal acts of the Republic of Lithuania, and to state institutions and courts when such an obligation is provided by applicable legislation.

3. YOUR RIGHTS

3.1. You have these main rights:

3.1.1. To get acquainted with the data processed by the Data Controller, data processing purposes, data storage period.

3.1.2. Require to correct or supplement the incorrect, incomplete, and inaccurate personal data or limit the processing of the data if it's incorrect. Also, require to destroy the personal data provided and suspend its processing.

3.1.3. Revoke any consent given to the Data Controller to use your data and suspend the processing of your data.

3.1.4. Do not consent to the processing of your personal data by the Data Controller or third parties for the purpose of pursuing a legitimate interest, including profiling.

3.1.5. Submit a complaint to the State Data Protection Inspectorate (A. Juozapavičiaus St. 6, 09310 Vilnius, Tel. (8 5) 271 2804, E-mail ada@ada.lt).

3.2. If you contact the Data Controller with a request for the exercise of your rights, a response shall be provided no later than within 30 calendar days from the date of the request. The Controller shall provide a response in the form in which the request was made and shall take action to enforce the rights of the individual. In exceptional cases provided for by law, the time limit for replying or exercising your rights may be extended by a further 2 months, provided that you are notified before the expiry of the initial 30-day time limit.

4. CHANGES TO THE PRIVACY POLICY

The Data Controller has the right to change the terms of the Privacy Policy. Any changes to the terms of the Privacy Policy will be announced on the Website. This version of the privacy policy was updated to 2022. March 1.
